ShipCarePro Terms of Service

These Terms of Service ("Terms") are entered into by and between you ("User" or "Customer") and ShipShape Biofouling Management LTD ("ShipCarePro," "we," "us," or "our"). By accessing or using the ShipCarePro platform ("Service"), you agree to comply with these Terms. If you do not agree, you may not access or use the Service.

These Terms are governed by the laws of the jurisdiction in which you reside or where ShipCarePro operates. For users in the European Union (EU), these Terms comply with the General Data Protection Regulation (GDPR). For users in the United States (US), these Terms comply with the California Consumer Privacy Act (CCPA) and other relevant regulations.

Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms, our Privacy Notice, and any other applicable policies. If you do not agree to these terms, you may not access or use the Service.

Account Registration

To use ShipCarePro, you must create an account. You agree to provide accurate, current, and complete information and to keep your account details up to date. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account, including those by invited users.

Biofouling Management Plan and Record Book

Each IMO number can only have one biofouling management plan and record book associated at a time. Transfers of ownership must be submitted and verified through the platform with appropriate documentation.

Subscription and Billing

ShipCarePro offers plans PER VESSEL:

  • One-Off Plan:$5,000 USD one-time setup. No refunds.
  • Accountable Plan:$1,200 USD/year per vessel. Cancel anytime. No refunds.
  • Hands-Off Plan:$5,000 USD setup + $750 USD/year subscription. No refunds.
  • Inspect Plan: Coming Soon.

Payment Options

1. Credit Card (Preferred): Processed by LemonSqueezy. Auto-renews unless cancelled.

2. Wire Transfer: Prepaid only. Access after receipt. Subject to DST compliance.

3. Free Trials: Convert to paid if not cancelled before trial ends.

Cancellation Policy & Data Retention

  1. Annual subscriptions. Cancel anytime. Auto-renew depends on payment type.
  2. No refunds. Access remains until end of term.
  3. 30-day grace period: AIS data continues, other features read-only.
  4. After grace: vessel disconnected from AIS, read-only mode enforced.
  5. 18-month inactivity: permanent data deletion.
  6. Data download available before cancellation.

Use of the Service

Users are responsible for the accuracy of data submitted. Use the Service legally and ethically. No reverse engineering, no illegal use, no harm to systems.

Security and Data Protection

We use Microsoft Azure (SOC 2 certified), and tools like LemonSqueezy, Zapier, MailChimp. No selling of user data. GDPR and CCPA compliant. See our Privacy Notice.

Termination

We may suspend/terminate for violations. You may cancel anytime. No refunds unless otherwise stated.

Payment Processing

Handled by third-party providers. We do not store credit card data.

Privacy

Governed by our Privacy Notice. GDPR and CCPA rights available, including access, deletion, and opt-out options.

Limitation of Liability

Not liable for indirect or consequential damages. Liability limited to payments in the last 12 months. Users are responsible for ensuring local compliance.

Dispute Resolution

Handled via arbitration in Vancouver, Canada. EU and US disputes follow respective laws.

Modifications to Terms

30-day notice for major changes. Continued use means acceptance of changes.

Intellectual Property

ShipCarePro content is owned by ShipShape Biofouling Management Ltd. Do not copy, distribute, or reverse-engineer.
